Use of the Platform

Eligibility

To use the Platform, you must be at least 18 years old or the legal age of majority in your jurisdiction. By using the Platform, you represent and warrant that you meet this requirement and are legally competent to enter into a contract.

Account Registration

Some features of the Platform require account registration. You agree to provide accurate, current, and complete information during the registration process and to keep this information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Orders and Transactions

Role of PizzaNow!, LLC

PizzaNow!, LLC connects users with independently owned pizzerias ("Pizzerias") for the purposes of placing food orders. We do not prepare food ourselves and are not responsible for the quality or delivery of food. Each Pizzeria is an independent business and solely responsible for its services.

Order Placement and Acceptance

When you place an order through our Platform, it is sent to the selected Pizzeria. The Pizzeria has the right to accept or decline the order. You will be charged once the order is accepted.

Pricing and Payment

All prices are listed in U.S. dollars. Prices and availability of items are set by the Pizzerias and may change without notice. You agree to pay all charges incurred in connection with your order, including applicable taxes and delivery fees.

Refunds and Cancellations

Refund and cancellation policies are established by each Pizzeria. PizzaNow!, LLC does not issue refunds on behalf of Pizzerias. Please contact the Pizzeria directly for issues with your order.

User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Misrepresent your identity or impersonate another person.
• Attempt to interfere with or compromise the security of the Platform.
• Use automated means (e.g., bots, scrapers) without our prior written consent.
• Post or transmit any abusive, defamatory, or obscene content through the Platform.

Intellectual Property

The Platform and its content (including logos, graphics, software, and text) are owned by PizzaNow!, LLC or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial use.

You may not:

• Reproduce, distribute, modify, or create derivative works without prior written permission.
• Use PizzaNow!, LLC’s name, trademarks, or branding in any way that implies endorsement or partnership without authorization.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” PizzaNow!, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• The availability, accuracy, or completeness of menu items or Pizzeria listings.
• That orders will be delivered on time or without error.
• That the Platform will be free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PizzaNow!, LLC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF OR INABILITY TO USE THE PLATFORM;
• TRANSACTIONS OR INTERACTIONS WITH PIZZERIAS;
• ANY DELAY OR FAILURE IN PERFORMANCE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT PAID BY YOU TO PizzaNow!, LLC IN THE PAST SIX MONTHS.

Indemnification

You agree to defend, indemnify, and hold harmless PizzaNow!, LLC, its affiliates, directors, officers, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

Termination

We may suspend or terminate your access to the Platform at any time and without prior notice if we reasonably believe that you have violated these Terms or are otherwise engaging in fraudulent or harmful activity.

Upon termination, your right to use the Platform will cease immediately. Provisions that by their nature should survive termination (e.g., indemnification, limitation of liability) shall survive.

Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them will be governed by the laws of the State of Wyoming, without regard to its conflict of law principles.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Wyoming. You consent to the jurisdiction of such courts and waive any objection to venue.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on the Platform or sending you an email. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
